7TH ANNUAL IRVINE PUBLIC SCHOOLS FOUNDATION RAFFLE

These Official Rules govern the conduct of the Raffle. By purchasing a raffle ticket, you agree to be bound by these Official Rules.

ELIGIBILITY

You must be 18 years of age or older to purchase tickets or win a prize. Tickets may only be purchased by California residents. Void where prohibited by law. The following individuals, and persons living in the same household of the following individuals, are not eligible to participate:
1.) Members of the Irvine Public Schools Foundation (“IPSF”) Board of Trustees,
2.) Employees of IPSF. Employees shall include, but are not limited to, those individuals employed by IPSF in connection with programs supporting the Irvine Unified School District, except that instructors in the Afterschool Classroom Enrichment Program (ACE) are eligible to purchase tickets.
3.) Employees of 3000 The Plaza, L.L.C & Associates
4.) Members of the Irvine Unified School District Board of Trustees; and,
5.) The Superintendent, Assistant Superintendents and Deputy Superintendents of the Irvine Unified School District.

TICKETS

Raffle tickets are $150 each. No more than 15,000 tickets will be sold, and no more than 16,000 tickets will be eligible for the grand prize drawing. IPSF reserves the right to award, give-away or otherwise issue up to 1000 tickets for promotional incentives or other purposes determined by IPSF. Raffle tickets must be purchased no later than 5:00 p.m. on Friday, July 30, 2010. Only one name may be entered on each ticket. If you disregard this rule and enter more than one name, the first person named on the form will be entered on the ticket. Division of a prize by a group purchasing a ticket shall be the sole responsibility of the person named as the winner. Raffle tickets may NOT be purchased in the name of a business, trust, corporation or any other entity. Altered tickets will be automatically disqualified.

Raffle tickets will be entered into the drawing on a first-come first-served basis in the order received by the IPSF. Completed Ticket Request Forms must be accompanied by valid payment to be eligible. Any Ticket Request Forms received with payment after 15,000 tickets have been sold or after 5:00 p.m. on July 30, 2010 will be returned, unless the deadline is extended by IPSF. No other refunds are available. Once issued, tickets can not be changed, sold or transferred by the purchasing party or anyone else. IPSF assumes no responsibility for lost, late, misdirected or non-delivered mail or other failure to deliver Ticket Request Forms or payment prior to any deadline.

Purchases of raffle tickets are not tax-deductible contributions. The IRS states that amounts paid for chances in raffles, lotteries or similar drawings for valuable prizes are not deemed as donations or gifts and consequently do not qualify as deductible charitable donations.

HOW TO PURCHASE

Tickets may be purchased by mail to: Irvine Public Schools Foundation, 18552 MacArthur Boulevard, Suite 200, Irvine, CA 92612; by fax at 949-265-6417; or by phone to the raffle hotline, 949-734-6873. An official Ticket Request Form may be obtained or orders can be placed directly by calling the raffle hotline, 949-734-6873. Raffle tickets can not be sold over the internet.

PAYMENT

Payments for raffle tickets may be made by check, credit card (Visa, Mastercard or Discover only) or cash. Checks shall be made payable to the Irvine Public Schools Foundation. Checks returned by the bank and charge backs made by credit card companies shall automatically disqualify the entrant.

EARLY BIRD AND MULTIPLE PURCHASE PRIZES

The Early Bird #1 Prize is a cash prize of $10,000.00. To be eligible for the Early Bird #1 prize, a completed Ticket Request Form and valid payment must be received by IPSF no later than 5:00 p.m. on Thursday, April 15, 2010. The winning Early Bird ticket will be drawn at random on Friday, April 30, 2010. The winner will be contacted directly by phone, and the name will be posted on the raffle website by 5:00pm that day.

The Early Bird #2 Prize is a 2010 BMW 328i sedan, MSRP approximately $33,675.00, final MSRP will depend on options selected by the dealer, or $20,000 cash, at the option of the prize winner. To be eligible for the Early Bird #2 prize, a completed Ticket Request Form and valid payment must be received by IPSF no later than 3:00 p.m. on Friday, May 14, 2010. Car options are subject to dealership stock on hand. The winning Early Bird ticket will be drawn at random on Friday, May 28, 2010. The winner will be contacted directly by phone, and the name will be posted on the raffle website by 5:00pm that day.

IPSF does not guarantee that the Early Bird Car winner will be able to sell the vehicle for its list price. Tax authorities may place a different value on the vehicle for the purposes of determining any income, property, transfer or other taxes that may be due from the Early Bird Prize winner. The winner of the Early Bird Prize is responsible for all fees, local, state and federal taxes, vehicle licensing, insurance, sales, use and transfer taxes. Payment or withholding of applicable taxes and fees will be required at the time of transfer of the prize to the winner.

The Early Bird #3 Prize is a Dream Vacation Package from The OCeanfront Experience -1 night package with dinner and spa treatments for two at each of their 6 coastal resorts (Hilton Waterfront in Huntington Beach, Hyatt Regency Huntington Beach Resort and Spa, Balboa Bay Club and Resort, Montage Laguna Beach, Surf and Sand Resort in Laguna Beach, The Ritz-Carlton in Laguna Niguel), retail value, $4,500. To be eligible for the Early Bird #3 prize, a completed Ticket Request Form and valid payment must be received by IPSF no later than 3:00 p.m. on Saturday, June 19, 2010. The winning Early Bird ticket will be drawn at random on Friday, July 2, 2010. The winner will be contacted directly by phone, and the name will be posted on the raffle website by 5:00pm that day.

The Early Bird #4 Prize is one year of rent-free living at an unfurnished 950 Sq Ft, two-bedroom, two-bath Logan plan type 22C8 at The Park at Irvine Spectrum Center. The prize has an estimated value $25,000. Utilities are not included and the winner must meet application approval criteria. The award is transferrable to a party who meets qualifying criteria. The winner must occupy the home within 90 days of receipt of the prize. The Prize Winner will be required to pay all fees, local, state and federal taxes.

To be eligible for the Early Bird #4 prize, ticket purchasers MUST OPT-IN on the form, to be entered into this drawing, and the completed Ticket Request Form along with valid payment must be received by IPSF no later than 5:00 p.m. on Friday, July 9, 2010. The winning Early Bird ticket will be drawn at random on Friday, July 23, 2010, from the pool of Opt-In participants only. The winner will be contacted directly by phone, and the name will be posted on the raffle website by 5:00pm that day.

MULTIPLE TICKET PURCHASERS

All raffle ticket buyers who purchase two or more tickets by 5:00pm, Friday, July 30, 2010, will be entered into an exclusive “Two or More” Ticket Purchaser Drawing during the Grand Prize Drawing Event for $5,000 cash. All raffle ticket buyers who purchase three or more tickets by 5:00pm, Friday, July 30, 2010, will be entered into an exclusive “Three or More” Ticket Purchaser Drawing on during the Grand Prize Drawing Event for $10,000 cash. All entries in the “Three or More” Ticket Purchaser Drawing are automatically entered into the “Two or More” Purchaser Drawing.

Multiple ticket purchaser eligibility is subject to the following conditions: 1) any two or more tickets that are purchased at any time during the bonus drawing sale period and are filled out with IDENTICAL NAMES AND ADDRESSES, and 2) all such ticket orders with full valid payment received by 5:00pm, Friday, July 30, 2010. The winning tickets from the Early Bird and bonus drawings remain eligible for all prizes in the Grand Prize Drawing Event.

Bonus incentive: All buyers who purchase five raffle tickets at one time, will get one ticket free. There is no limit on how many tickets an individual can purchase.

GRAND PRIZE DRAWING

GRAND PRIZE: The Grand Prize drawing will be held at a public event on Saturday, August 21, 2010. Location will be determined at a later date and posted on the Official Raffle Website. The Grand Prize is a brand new condominium home with The Plaza community, developed by 3000 The Plaza, with a list price of approximately $700,000. The unit is Plan B 4 Condominium home, #304 of Tract 16843, situated at 3000 Scholarship, Irvine, CA, and will be provided without furniture or decorations and will include the standard one (1) year limited warranty offered to all buyers as required by law . Alternatively, the Grand Prize winner may elect to receive a cash prize of $500,000. Grand Prize winner must make his or her election in writing on or before 5:00 p.m. on Friday, September 3, 2010. If Grand Prize winner does not make an election by that date, he or she will be deemed to have elected to take the cash prize.

OTHER PRIZES: One cash prize of $20,000. Two cash prizes of $10,000, Three cash prizes of $5,000, Three cash prizes of $2,500, Five cash prizes of $1,000, Thirty cash prizes of $500, Thirty cash prizes of $300.

In the event that all 15,000 tickets are sold well in advance of the final deadline, the Grand Prize drawing may be moved up to an earlier date, pending the completion of all processing and auditing.

If fewer than 11,200 tickets have been sold on or before 5:00 p.m. on July 30, 2010, the Grand Prize will be a cash prize equal to 50% of the total proceeds of the ticket sales less expenses incurred by IPSF. All other prizes will be awarded as described. No substitutes for prizes will be made.

Winners are responsible for all fees, local, state and federal taxes, and any other taxes and fees payable as a result of winning a prize. Payment or withholding of applicable taxes and fees will be required at the time of transfer of the prize to the winner.

SELECTION OF WINNERS & ODDS OF WINNING

Winning tickets will be drawn at random at the dates specified above from all eligible raffle tickets entered. Ticket purchaser does not have to be present to win. Odds of winning the Grand Prize or any of the other prizes in the Grand Prize Drawing Event will be 1 in 15,000. Odds will improve if fewer tickets are sold. Odds of winning any prize will depend on the number of eligible raffle tickets sold by the applicable deadline.

All prizes will be awarded. All prize winners will be contacted directly and will be listed on the IPSF website for at least 30 days after the drawing date. If, however, any winner cannot be located within 15 days after the drawing, after making reasonable attempts to do so, or if the winner is deemed to be ineligible, such winner will be deemed to have forfeited his or her prize and alternative winners will not be drawn.

A list of winners may be obtained by sending a self addressed stamped envelope to the Sponsor. Requests in writing must be received by December 31, 2010.

GENERAL TERMS AND CONDITIONS

By purchasing a raffle ticket, you agree to be bound by these Official Rules and the decisions of the Sponsor, which shall be final. Winners will be required to execute an affidavit of eligibility and a publicity and appearance release permitting IPSF to use their name, photograph, likeness and voice for promotional purposes in any media. All winners are required to present proof of identity satisfactory to IPSF, in IPSF’s sole discretion, matching the name on the winning ticket. IPSF is not responsible for any injuries, losses or damages of any kind arising in connection with or as a result of the winner’s acceptance or use of any prize. Winner agrees to indemnify, defend (with counsel acceptable to IPSF) and hold IPSF and each of their respective officers, directors, shareholders, employees, agents and affiliated entities, harmless from any and all losses, damages, rights, claims and actions of any kind arising in connection with or as a result of the winner’s acceptance or use of the prize.
